Occupied El Aaiun, 31 Janauary 2026 (SPS) — The Sahrawi Body Against the Moroccan Occupation (ISACOM) has called on the European Union (EU) to comply with the rulings of the Court of Justice of the European Union (CJEU), which affirm that Western Sahara and Morocco are “two distinct territories,” stressing that the freedom of the Sahrawi people is non-negotiable.
In a statement, ISACOM condemned any attempt by the EU to conclude political and economic partnerships with Morocco that could prolong the occupation of Western Sahara, sharply criticizing the EU’s double-standards policy in dealing with international issues—an approach the body described as “morally and legally reprehensible.”
ISACOM further noted that the EU cannot ignore Morocco’s illegal occupation of Western Sahara for more than 50 years, denouncing efforts to strip the Sahrawi people’s right to self-determination of its substance. This right is enshrined in the Charter of the United Nations and was unequivocally affirmed by the International Court of Justice (ICJ) in its historic advisory opinion issued on 16 October 1975.
The statement recalled that successive CJEU rulings, notably the 2016 judgment, have considered Western Sahara to be a territory distinct from Morocco and that it cannot be included in any agreement between the EU and Morocco without the consent of the Sahrawi people and their legitimate representative, the Polisario Front.
