European Court of Justice ruling on Sahrawi natural resources establishes legal framework affirming justice of Sahrawi cause (Algerian Academic)

Boumerdès, August 6, 2025 (SPS) – Algerian academic Dr. Benmansour Abdelkrim emphasized during his address at the Summer University for Polisario Front and Sahrawi State executives that the European Court of Justice's ruling on Sahrawi natural resources constitutes a legal framework reinforcing the legitimacy of the Sahrawi cause.

In a lecture titled "The Legal Framework of the Sahrawi Cause: Another Setback for Moroccan Occupation," Dr. Benmansour stated that the ruling clearly affirmed that Western Sahara and the Kingdom of Morocco are "distinct territories" and that the Polisario Front remains the sole legitimate representative of the Sahrawi people. This aligns with international law and the 1975 advisory opinion of the International Court of Justice (ICJ), which denied any ties of territorial sovereignty between Western Sahara and Morocco.

The academic underscored that all international conventions recognize that no solution can be imposed against the will of the Sahrawi people in exercising their right to self-determination. He noted that the United Nations has consistently upheld this principle despite Morocco’s maneuvers and international complicity in obstructing UN and Security Council resolutions.

Dr. Benmansour argued that the optimal solution for all parties lies in a referendum allowing the Sahrawi people to exercise their right to self-determination, as stipulated by international law.

He further highlighted that the Moroccan regime, since its occupation of Western Sahara, has systematically distorted facts, expanded its control over Sahrawi territory, and signed illegal agreements to plunder natural resources—in direct violation of international law.

In conclusion, the lecturer affirmed that the Sahrawi people, who continue to resist Moroccan colonialism with unwavering determination, will ultimately achieve victory. "As long as a people fights to liberate its land and build an independent state—like all nations that have struggled against colonization—their triumph is inevitable," he declared.
